Does the Driver’s Insurance Pay if They Hit a Pedestrian?

In many rideshare accidents, who pays for damages depends on the driver’s status at the time of the crash. If the Uber or Lyft driver was logged into the app and actively transporting a passenger or en route to pick one up, then each company’s liability insurance policy may cover your medical bills, lost income, and other damages.

If the driver was logged in but not carrying a passenger, a lower level of contingent coverage applies—and if they were completely off the app, their personal auto insurance would generally be responsible.

To hold Uber, Lyft, or another rideshare company liable, it’s often necessary to show that the driver was both on duty and negligent. Common forms of driver conduct or negligence that can lead to rideshare company coverage include:

  • Driving while distracted by the rideshare app, GPS, or mobile phone
  • Speeding to reach a destination or accept a new fare
  • Running red lights
  • Failing to yield when merging or turning
  • Making unsafe lane changes or sudden stops that cause a collision
  • Driving while drowsy after long hours behind the wheel
  • Driving under the influence of alcohol or drugs
  • Ignoring traffic signs, signals, or road markings
  • Following too closely or tailgating another vehicle

How Much Compensation Can Uber’s Insurance Policy Pay?

When the driver is between trips. If an Uber driver is logged into the app but has not yet accepted a ride, their personal auto insurance is the primary coverage. If that policy does not meet the required minimum limits, Uber’s contingent liability policy may apply—offering up to $50,000 per injured person, $100,000 per accident, and $25,000 in property damage.

When the driver is on a trip. Once a trip is accepted and until the passenger is dropped off, Uber’s $1 million policy takes effect. This includes up to $1 million in liability coverage if the Uber driver caused the crash, and up to $1 million in uninsured/underinsured motorist coverage if another driver caused the accident but has insufficient insurance to cover your losses.

When the driver is offline. If the Uber driver is not logged into the app, Uber’s insurance does not apply, and the driver’s personal auto insurance is solely responsible for damages.

IMPORTANT!

Uber is known for aggressively defending itself against personal injury claims. The company has retained elite defense firms and is backed by extensive legal resources, making it a challenge for injured victims to secure fair settlements without strong representation.

Because Uber drivers are classified as independent contractors, the company often argues it is not directly liable for a driver’s negligence. Overcoming these legal strategies requires a lawyer who understands rideshare insurance rules, knows how to pressure corporate insurers, and can take your case to court if needed.

Working with an experienced Los Angeles rideshare accident attorney gives you the best chance of securing the maximum compensation you’re entitled to under Uber’s coverage.

5 Reasons Why You Need a Lawyer

Hiring a lawyer after a rideshare accident in Los Angeles is one of the smartest decisions you can make — especially if you’ve suffered serious injuries. See five key reasons why below.

  1. Serious injury claims. Collisions involving Uber or Lyft vehicles often result in serious injuries. A lawyer experienced in rideshare accident cases can build a strong claim to help you recover the maximum compensation for your medical bills, lost income, long-term care needs, and other non-economic damages.
  2. Protecting you from blame. Under California’s comparative fault laws, insurance companies may argue you were partly responsible for the accident—for example, by claiming your actions contributed to the crash. Your attorney can gather evidence to show the rideshare driver was at fault, and protect you from unfair liability.
  3. Maximising your settlement. Insurance companies often downplay the severity of pedestrian injuries and offer low settlements—especially those representing Uber and Lyft. A lawyer knows how to calculate the full value of your claim, factoring in current and future medical costs, lost earning capacity, and the pain and suffering you’ve endured.
  4. Navigating complex insurance issues. Rideshare accidents can involve multiple liable parties, including the rideshare driver, other motorists, the rideshare company’s insurer, or even a commercial vehicle operator. A skilled attorney understands California’s insurance and liability rules—as well as Uber and Lyft’s coverage policies—and can manage these complexities from day one.
  5. Building strong evidence. Winning a rideshare accident claim requires detailed proof—such as eyewitness statements, dashcam or app data, traffic camera footage, police reports, medical records, accident reconstruction, and expert testimony. A lawyer knows how to collect, preserve, and present this evidence to strengthen your case.

If you’ve just recently sustained injuries following an accident, you should know there are state laws that protect your access to the very best accident attorneys.

Our process begins with a free, confidential, and zero-obligation consultation about your situation. You can call us now at +1 (424) 404-5140 to speak directly with an attorney.

We’ll ask about the injuries you sustained, how the collision happened, and any interactions you’ve already had with Uber, Lyft, their insurers, or other lawyers. We may also request specific documents—such as accident reports or medical records—to help us assess the maximum value of your claim.

Next, we’ll explain the terms of our no-win, no-fee representation, giving you complete peace of mind about hiring top legal representation with no upfront costs. You’ll know our contingency fee structure and ask as many questions as you like before hiring us as your legal advocates.

Then, over the following months, your rideshare accident case will typically move through these stages:

  1. Immediate Investigation & Evidence Collection. We’ll quickly begin investigating the collision — gathering police reports, medical records, witness statements, dashcam or traffic camera footage, Uber or Lyft trip logs, and, where applicable, accident reconstruction analysis. These details help us prove how and why the rideshare driver or another party was at fault.
  2. Formal Claim Submission & Demand Letter. We will submit a formal claim, or demand letter, to the at-fault party’s insurer. This may involve claims against the rideshare driver’s personal insurer, Uber or Lyft’s corporate insurance policy, or other drivers involved in the crash.
  3. Negotiations and Insurance Mediation. After filing the claim, we negotiate aggressively with the insurance companies representing all liable parties. If settlement talks stall, California offers a structured option—mediation through the Department of Insurance’s Automobile Claims Mediation Program—to help resolve disputes without immediate litigation.
  4. Filing a Lawsuit (If Needed). If negotiations or mediation fail, your lawyer will file a lawsuit. Under California law, you generally have two years from the date of the accident to file a personal injury claim, but claims against government entities (such as those involving unsafe road conditions) have much shorter deadlines.
  5. Trial Preparation & Court Representation. If your rideshare accident case proceeds to court, your attorney will handle discovery, file motions, work with expert witnesses (such as accident reconstructionists or rideshare industry experts), attend hearings, and ultimately present your case at trial. Your legal fee will remain as agreed in your original no-win, no-fee contract.
